Agreement to These Terms

These Terms & Conditions govern purchases from Not Just Toyz LLC ("Not Just Toyz," "we," "us," or "our"), whether completed directly through our website or through an authorized third-party shopping or checkout experience.

By accessing our website, creating an account, or placing an order with Not Just Toyz, you agree to these Terms & Conditions and any policies referenced within them. Please review these terms before completing a purchase.

Certain products, services, promotions, or payment methods may be subject to additional terms disclosed at the time of purchase.

Payments & Orders

All prices are listed in U.S. Dollars unless otherwise indicated.
We accept the payment methods displayed as available during checkout. Available payment methods may change from time to time.
Applicable sales taxes, duties, fees, and other charges will be calculated and collected where required by applicable law.
Submitting an order does not guarantee acceptance of the order. An order is considered accepted after payment has been successfully authorized and the order has been accepted for fulfillment.
We reserve the right to review, refuse, limit, or cancel an order when reasonably necessary, including in cases of suspected fraud, unauthorized payment activity, pricing or listing errors, inventory discrepancies, supplier cancellations, product availability issues, or violations of these Terms.
If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method unless another resolution is agreed upon.
We may contact customers to verify order, billing, payment, shipping, or identity information before fulfillment.

Product Information & Availability

We make reasonable efforts to ensure that product descriptions, photographs, pricing, availability, and other information displayed on our website are accurate. However, errors may occasionally occur.

Product colors, packaging, accessories, artwork, and other details may vary slightly from photographs or manufacturer promotional images.
Manufacturers may make production or packaging changes without notice.
Prices and availability are subject to change without notice prior to purchase.
An item appearing as available does not guarantee that inventory will remain available until the order has been accepted and processed.
If an item becomes unavailable after an order is placed, we will contact you regarding available options, which may include a refund.

Pre-Orders

Products identified as Pre-Order are products that we expect to receive from a manufacturer or distributor but that are not yet available in our warehouse for immediate shipment.

Payment for pre-order items is collected at the time the order is placed.
Pre-order purchases are final and cannot be cancelled once the order has been placed.
Estimated arrival or release dates are provided for informational purposes only and are not guaranteed.
Manufacturers and distributors may change release dates, delay products, reduce allocations, or cancel products entirely.
Pre-orders are generally fulfilled in the order received, subject to supplier allocations and product availability.
If an order contains both in-stock and pre-order products, the order will generally ship once all items are available unless separate shipping arrangements are made.
A manufacturer or distributor delay, release-date change, or allocation delay does not make a pre-order eligible for customer-requested cancellation.
If we are unable to fulfill a pre-order because of a manufacturer cancellation, supplier allocation, discontinuation, or other availability issue, Not Just Toyz may cancel the affected item and issue a full refund for that item.

Shipping & Delivery

Shipping charges, available shipping methods, free-shipping thresholds, and other shipping terms are displayed during checkout and/or on our Shipping & Returns page.

In-stock orders typically ship within the processing timeframe stated in our Shipping & Returns Policy.
Business days generally exclude Saturdays, Sundays, and U.S. holidays.
Delivery dates and carrier transit times are estimates and are not guaranteed.
Tracking information will generally be provided when an order ships.
Carrier delays caused by weather, transportation disruptions, customs processing, peak-season volume, natural disasters, or other circumstances outside our reasonable control may affect delivery times.
Customers are responsible for providing a complete and accurate shipping address when placing an order.
Additional shipping charges resulting from an incorrect, incomplete, undeliverable, or changed address may be the customer's responsibility where permitted by law.
International customers are responsible for applicable customs duties, import taxes, brokerage fees, and other charges imposed by the destination country unless otherwise stated at checkout.
Some products may be restricted from shipment to certain countries or destinations.

Returns & Refunds

Eligible products may be returned within 30 days of receipt, subject to our Shipping & Returns Policy.

Returned merchandise must be unopened, unused, in its original condition, and include all original packaging and packing materials.
Opened merchandise is not eligible for a standard return unless otherwise required by law.
A Return Merchandise Authorization (RMA) must be requested before merchandise is returned.
Unauthorized returns may be refused.
For standard returns, original shipping charges are non-refundable and the customer is responsible for return shipping.
If we shipped an incorrect item or an item arrives damaged, please contact us promptly so we can review the issue and provide appropriate instructions.
Clearance, final-sale, or other products specifically identified as non-returnable may not be eligible for return.
Refunds for approved returns are generally processed within 5–7 business days after the returned merchandise is received and inspected.
Financial institutions and payment providers may require additional time before a refund appears on the customer's account.

Collectible & Packaging Condition

Not Just Toyz sells toys, action figures, statues, collectibles, and other merchandise for which packaging condition may be important to some customers.

Unless specifically identified otherwise, products are sold as new merchandise. However, we do not guarantee mint-condition packaging.

Products may arrive from manufacturers or distributors with minor packaging imperfections such as small dents, creases, scratches, scuffs, corner wear, window imperfections, sticker placement variations, or other minor cosmetic differences.

We take reasonable care when storing and packaging merchandise for shipment, but minor packaging imperfections that do not affect the product itself are not necessarily considered product defects.

Customers who require a specific packaging condition are encouraged to contact us before placing an order.

Third-Party Shopping & Checkout Services

Not Just Toyz products may be displayed or made available for purchase through approved third-party platforms, shopping services, marketplaces, digital assistants, or checkout experiences.

Unless otherwise indicated, purchases of Not Just Toyz merchandise through an authorized third-party checkout experience remain subject to these Terms & Conditions and our applicable store policies.

A third-party service may also have its own terms, privacy practices, payment requirements, or platform rules that apply to your use of that service.

Rewards, Promotions & Discounts

Not Just Toyz may offer rewards programs, coupons, promotional codes, discounts, referral offers, free-shipping offers, or other promotions from time to time.

Promotions may be subject to eligibility requirements, expiration dates, product exclusions, minimum purchase requirements, or other restrictions.
Unless specifically stated otherwise, promotional offers and discount codes may not be combined.
Promotional offers have no cash value except where required by law.
We reserve the right to modify or discontinue promotions or rewards programs as permitted by applicable law.
We may cancel rewards, discounts, or promotional benefits obtained through fraud, abuse, manipulation, duplicate accounts, or other misuse of a promotion or rewards program.

SMS Messaging Terms

If you voluntarily provide your mobile telephone number and opt in to SMS messaging, you consent to receive recurring automated marketing and informational text messages from Not Just Toyz, which may include promotions, product updates, order-related messages, and cart reminders.

Consent to receive marketing text messages is not a condition of purchase.
Message frequency may vary.
Message and data rates may apply.
To stop marketing text messages, reply STOP.

Wireless carriers are not responsible for delayed or undelivered messages.

Customer Accounts

Customers may have the option to create an account on our website. You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

Please notify us promptly if you believe your account has been accessed or used without authorization.

We reserve the right to suspend or terminate accounts that are used fraudulently, unlawfully, or in violation of these Terms.

Prohibited Use

You may not use our website or services to:

Engage in fraudulent, deceptive, unlawful, or abusive activity;
Attempt to interfere with the security or operation of the website;
Use automated systems to access, scrape, copy, or interfere with the website except as authorized by us or permitted by law;
Attempt to obtain unauthorized access to customer accounts, systems, or information;
Submit false or misleading account, payment, billing, shipping, or identity information; or
Use our services in a manner that violates applicable law or the rights of another person or entity.

Intellectual Property

The Not Just Toyz name, website design, logos, graphics, photographs, text, product descriptions created by us, and other original website content are owned by or licensed to Not Just Toyz and are protected by applicable intellectual property laws.

Third-party product names, characters, trademarks, logos, images, and other intellectual property remain the property of their respective owners.

Website content may not be copied, reproduced, distributed, republished, or commercially exploited without permission except as permitted by applicable law.

Product Warranties

Some products may be covered by warranties provided directly by their manufacturer. Manufacturer warranties, when available, are provided by the manufacturer and are subject to that manufacturer's own terms and conditions.

Unless otherwise expressly stated by Not Just Toyz, we do not provide an additional manufacturer-style warranty beyond rights that may be available to you under applicable law.

Limitation of Liability

To the fullest extent permitted by applicable law, Not Just Toyz shall not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use of our website, services, or products.

To the fullest extent permitted by applicable law, our aggregate liability arising from a particular purchase shall not exceed the amount paid to Not Just Toyz for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is described in our Privacy Policy.

Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, services, policies, technology, or applicable law.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable consumer protection laws require otherwise.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
